These Terms of Service ("Terms") govern your use of the Life Now & Beyond application and website (collectively, the "Service") operated by Top Artists 4 U LLC, a California limited liability company ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account or using our Service, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, please do not access or use the Service.
Life Now & Beyond provides tools for personal life organization, document storage, legacy planning, caregiver support, and after-loss guidance. You agree to:
You retain full ownership of all documents, notes, information, and content you upload or create within the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and will never sell it or share it with third parties except as described in our Privacy Policy.
The Service uses Google Firebase and Firestore, cloud infrastructure provided by Google LLC, to store and process your data. By using the Service, you acknowledge that your data will be stored on Google-managed servers in accordance with Google's terms of service and privacy policies. We encourage you to review Google Firebase's privacy documentation for more information.
The Trusted Access feature allows you to designate specific individuals to access certain portions of your Life Binder in emergencies or other circumstances you define. You are solely responsible for managing these permissions, including granting and revoking access. We recommend reviewing your Trusted Access settings regularly. Top Artists 4 U LLC is not responsible for any actions taken by individuals you have authorized through the Trusted Access feature.
Certain features of the Service are available through a paid subscription at the following rates:
Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time through your account settings or by contacting us at support@lifenowandbeyond.com. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods except where required by applicable law.
The Service is designed to help you organize personal information and access educational resources. Top Artists 4 U LLC does not provide legal, financial, medical, tax, or estate planning advice. Nothing in the Service constitutes professional advice of any kind. Always consult a qualified attorney, financial advisor, or other licensed professional for matters requiring professional expertise.
Top Artists 4 U LLC operates the Life Now & Beyond Facilitator Program (the "Facilitator Program") solely as a curriculum developer, program administrator, and technology platform. The Company does not employ, supervise, direct, control, or manage Registered Facilitators in any respect. The Company's role is limited to: (i) issuing registration approvals upon approval of Facilitator applications; (ii) providing access to the Facilitator Portal and associated technology tools; (iii) licensing curriculum materials to Registered Facilitators; and (iv) processing enrollment payments and facilitating payouts in accordance with the Program terms. Nothing in these Terms, the Facilitator Program structure, or any related communications shall be construed to create an employment relationship, agency relationship, partnership, joint venture, or franchise between the Company and any Registered Facilitator.
All Registered Facilitators are independent contractors who operate their own independent businesses. Registered Facilitators are solely responsible for: (i) determining the manner, method, time, place, and means by which they conduct program sessions; (ii) their own conduct, statements, representations, and actions before, during, and after any program session; (iii) compliance with all applicable federal, state, and local laws, regulations, licensing requirements, and professional standards governing their activities; (iv) payment of all applicable federal, state, and local taxes, including self-employment taxes; (v) obtaining any required business licenses, permits, or professional certifications independent of the Life Now & Beyond program; and (vi) maintaining any insurance coverage they deem appropriate for their activities. The Company does not withhold taxes, provide workers' compensation coverage, unemployment insurance, or any other employment benefits to Registered Facilitators.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOP ARTISTS 4 U LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "COMPANY PARTIES") SHALL NOT BE LIABLE FOR ANY ACT, OMISSION, STATEMENT, REPRESENTATION, MISREPRESENTATION, NEGLIGENCE, GROSS NEGLIGENCE, RECKLESSNESS, INTENTIONAL MISCONDUCT, OR UNLAWFUL CONDUCT OF ANY REGISTERED FACILITATOR, WHETHER OCCURRING BEFORE, DURING, OR AFTER ANY PROGRAM SESSION. THIS LIMITATION APPLIES WITHOUT REGARD TO WHETHER THE COMPANY HAD ACTUAL OR CONSTRUCTIVE KNOWLEDGE OF THE FACILITATOR'S CONDUCT OR THE POSSIBILITY OF HARM.
Without limiting the foregoing, the Company Parties shall not be liable for any claim arising from or relating to: (i) the quality, accuracy, completeness, or appropriateness of any information, guidance, or instruction provided by a Registered Facilitator; (ii) any emotional, psychological, physical, or financial harm alleged to result from participation in a program session; (iii) a Facilitator's failure to conduct sessions in accordance with the curriculum or Program guidelines; (iv) a Facilitator's misrepresentation of their qualifications, experience, or credentials; (v) any statements made by a Facilitator that constitute legal, financial, medical, tax, estate planning, or therapeutic advice; (vi) any dispute between a Facilitator and a program participant arising from enrollment, attendance, conduct, or payment; (vii) a Facilitator's failure to maintain confidentiality of participant information; or (viii) any criminal, tortious, or otherwise unlawful act or omission by a Facilitator.
The Life Now & Beyond Facilitator Program is an educational program only. The curriculum, Teacher's Guide, companion books, program materials, and all content delivered by Registered Facilitators are provided for general informational and educational purposes only and do not constitute, and shall not be construed as, legal advice, financial advice, investment advice, tax advice, medical advice, psychological counseling, grief therapy, estate planning services, or any other form of licensed professional services. Participation in the program does not create any professional-client relationship of any kind. Participants are strongly encouraged to consult qualified, licensed professionals for all matters requiring professional expertise.
THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING: (i) THE QUALIFICATIONS, COMPETENCE, CHARACTER, OR SUITABILITY OF ANY REGISTERED FACILITATOR; (ii) THE ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY INFORMATION PROVIDED BY A REGISTERED FACILITATOR; (iii) THE RESULTS OR OUTCOMES THAT ANY PARTICIPANT MAY ACHIEVE FROM PROGRAM PARTICIPATION; OR (iv) THE CONDUCT OR PERFORMANCE OF ANY REGISTERED FACILITATOR. REGISTRATION BY THE COMPANY REPRESENTS ONLY THAT A FACILITATOR HAS MET THE COMPANY'S ADMINISTRATIVE APPLICATION REQUIREMENTS AND DOES NOT CONSTITUTE AN ENDORSEMENT, RECOMMENDATION, OR GUARANTEE OF ANY FACILITATOR'S QUALIFICATIONS OR CONDUCT.
By enrolling in any Life Now & Beyond Facilitator Program session, each participant expressly acknowledges and agrees that: (i) participation is entirely voluntary; (ii) the program involves discussions of sensitive topics including death, loss, grief, estate planning, and financial matters, which may be emotionally challenging; (iii) the participant assumes all risk associated with participation, including any emotional distress or discomfort arising from program content or discussions; (iv) the Company Parties are not liable for any harm, injury, distress, or damages of any kind arising from the participant's enrollment in or attendance at any program session; and (v) the participant's sole recourse for any dispute arising from a program session is against the individual Registered Facilitator, not against the Company.
All enrollment fees paid by program participants are non-refundable under all circumstances, including but not limited to: a participant's decision not to attend sessions; a participant's dissatisfaction with the program or Facilitator; scheduling conflicts; illness; relocation; or any other personal circumstance. This no-refund policy is clearly disclosed prior to payment and constitutes a material term of the enrollment agreement. In the event of a verified, documented failure by a Registered Facilitator to deliver all six program sessions, the Company may, in its sole discretion, take remedial action against the Facilitator in accordance with Program policies, but the Company is not obligated to issue refunds to participants from its own funds.
Each Registered Facilitator, by completing registration and accessing the Facilitator Portal, agrees to indemnify, defend (with counsel reasonably acceptable to the Company), and hold harmless the Company Parties from and against any and all claims, demands, actions, causes of action, judgments, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (i) the Facilitator's conduct in connection with any program session; (ii) the Facilitator's breach of the Facilitator Independent Contractor Agreement or these Terms; (iii) the Facilitator's violation of any applicable law, regulation, or professional standard; (iv) any misrepresentation made by the Facilitator to participants, the Company, or any third party; (v) any claim by a program participant arising from the Facilitator's conduct; or (vi) the Facilitator's gross negligence or willful misconduct. This indemnification obligation shall survive termination of the Facilitator's registration.
The Company reserves the right, in its sole and absolute discretion and without prior notice, to suspend or permanently revoke a Facilitator's registration and terminating access to the Facilitator Portal upon: (i) any breach of these Terms or the Facilitator Independent Contractor Agreement; (ii) any conduct by the Facilitator that the Company determines, in its sole judgment, to be harmful to participants, the Company's reputation, or the integrity of the program; (iii) receipt of credible complaints from participants; (iv) any criminal charge, conviction, or civil judgment against the Facilitator involving moral turpitude, fraud, dishonesty, or violence; (v) the Facilitator's insolvency or bankruptcy; or (vi) any other reason the Company deems sufficient to protect participants, the program, or the Company. Revocation of registration does not entitle the Facilitator to a refund of any fees paid or earnings withheld pending review.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Your use of the Service is at your own risk.
To the maximum extent permitted by applicable law, Top Artists 4 U LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim or (b) $100.
You agree to indemnify, defend, and hold harmless Top Artists 4 U LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.
We reserve the right to suspend or terminate your account and access to the Service at our discretion if you violate these Terms or engage in conduct that we determine to be harmful to other users or the Service. You may terminate your account at any time by contacting us at support@lifenowandbeyond.com. Upon termination, your data will be handled in accordance with our Privacy Policy.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice within the Service, and we will update the "Last updated" date above. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Top Artists 4 U LLC with respect to the Service and supersede all prior agreements and understandings.
